Problems At Work After Maternity Leave

Question to Ask the Workplace Doctors about maternity and work from home:

Since returning from maternity leave, my boss has rescinded the offer to let me work from home part time and get paid on an hourly basis. It seems like they are trying to make me quit so I do not collect unemployment (in NYS) At this point I am an emotional wreck. They are making inappropriate/hurtful comments and making it emotionally impossible for me to do my job. Is this grounds for leaving and filing for unemployment? I have some proof but not much.

Federal Holidays

Question to Ask the Workplace Doctors about federal holidays:

I am wondering what are the federal holidays for an hourly employee who working part time?

Signed, Wondering

Dear Wondering:

Federal holidays refer to holidays for federal employees, not holidays that are nationwide or that private business has to acknowledge by closing.  So, the only way to know what “federal holidays” you will be given as a day off, would be to ask your own HR or personnel office, or your manager. It may be that you won’t have any of those days off–or you may have some of them, but not all of them. Ask at your work about the holiday and vacation schedule for part time employees, and I’m sure you’ll find out what you need to know. Best wishes with this.

My Boss Cut Me Back To Part Time

Question to Ask the Workplace Doctors about being cut to part time:

I have been in my job for 12 months. For the last 3 months I have been full time, on salary($40,000). Yesterday morning my boss called me into his office and told me he is making me casual (part time) again. I work night shift in a hotel. The reason for him doing this was that no one will ever cover my shift for my RDO’s or sick days, so he is getting rid of the shift altogether. Can he do this?

My boss refused to provide me with a copy of my contract for the time I was full time. I and my partner have just had our first born and he knows this but he said “Tough.” I cant support my family because of what he has done. I really need some help in finding out if he can do this. If the other staff won’t do their jobs, why do I get punished for it? Please give me some advice. I spoke with my union and they said that there isn’t much they can do cause my hotel doesn’t employ more than 100 staff. I need my full-time employment back to provide for my family.

Boss Cursed Me

Question to Ask the Workplace Doctors about boss who curses and threatens:

I am a 35-year-old black female. I was called back to this company off of another job I was working. I have done great things at this job and got a lot of the previous money due back for the owner. I have been here since 7/9/07; I got a raise my 1st 90 days of $1.00. Well the next time it came time for a raise, I was told to get more money. Then I was told things are bad and we can’t afford raises, but we want you to do self-evaluation to get a raise. We did that, nothing. So I waited patiently because I was told things are bad and we don’t have money for raises.

Question to Ask the Workplace Doctors about the rules for FMLA:

I have written before and am still having issues. Can you tell me the rules for FMLA? I took 4 days off last year for surgery and was given an “occurence.” When I confronted my employer and told her I gave her a month notice, and should not have been given an occurence for this, she stated to me they are such a small company they do not have to go by FMLA rules. Is this true? My husband is a supervisor and says anything over 3 days with a doctor note falls under FMLA and I should not be written up or given an occurence. Please help me with this, This is my manager as well as the HR person over me. If I go over her head, I will pay dearly.

Need My Employment Records

Question to Ask the Workplace Doctors about records:

I have asked your advise awhile ago, and the issue is still there. So I decided to ask you again. My issue is, I am at a position of getting some documents which will be used for my immigration purpose. I have been employed by this company for almost two month, and I am not even able to get a job offer letter. The HR department is short staff at the moment, and HR manager has been saying that she does not have resource to go ahead with my application, and I am eligible to work in Canada.

Leave of Absence

Question to Ask the Workplace Doctors about a  leave of absence by psychologist:

Can a psychologist allow a patient time off/ leave of absence?

Signed, Wondering

Dear Wondering:

If you are asking if a psychologist can require an employer to give time off to a patient of his or hers, the answer will depend upon the situation. If the psychologist works for the employer and has been asked to examine the employee and make a recommendation, the psychologist might recommend time off. There are also times when Workmen’s Compensation might be involved in the situation, and a doctor or psychologist might say that time off was needed. But, if the patient is going on her own, an employer isn’t obligated to give time off just because a psychologist says it is needed.

Was not given 3 1/2 % raise

Question to Ask the Workplace Doctors about shorted in raise and bonus:

Hi, when I was hired 2 yrs ago I was told I would get the 3 1/2% raise every year. Now I just had my 2 yr review and it was a good review considering the past two yrs I have had some conflicts with my manager. I was only given 2 1/2 percent at my review. When I said in the interview “You stated 3 1/2 percent would be given each year”, I was told they are watching the budget. I know we are in some hard times, but I also know we are doing very well. The manager even stated they are just cutting back a little but will hire us a new girl to help out soon because we are so understaffed. I am very upset because I know the girl next to me got 3 1/2 percent in January. How do I handle this? Also my Christmas bonus was less than everyone else got. What is going on? Does she want me to leave, or am I being taken advantage of? I feel I deserve the 3 1/2 percent and feel sour at the at the thought of staying where I am not going to be treated fairly. Thanks for your advice.

No Work! What Now?

Question to Ask the Workplace Doctors about Being told not to come to work:

My boss has called me every day for the past 3 weeks and told me not to come in to work. What can I do about this?

Signed, Worried

Dear Worried:

I’m very, very sorry about the situation with your work. I don’t know the nature of your job or if you have a contract or not. Often employers hire people on an as needed basis. Sadly, if it is an unexpected situation, the employee has no way of being able to plan or budget…or pay bills. Is this caused because the employer is not getting business and doesn’t need you? (Carpet installation, construction, etc.) Or is it because there is something else going on? (Problems with your work situation in general.) Or, is it simply the nature of the work? (Seasonal or only when certain situations are present?)

Should I Ask For More Money to Start?

Question to Ask the Workplace Doctors about pay: I should get paid more.

Here’s the scoop. I work in IT. I graduated college 6 months ago and started working for a big corporation almost 5 months ago. My IT team is small: with 1 other person near me and 1 other person 600 miles away at another office (who visits once per month). Of hundreds of people at my office, I’m basically almost the only software developer. So, I have a lot on my plate.

During my interview, my employer told me they’d like me to learn to develop IBM Lotus Notes applications (kinda like forms). They understand it’s dying and that hardly anyone is fluent in Lotus development. But, they figured I could learn fairly easily and include it as part of my job description. So in summary, I have all my regular stuff which takes up all of my time. Then, I’ve ordered some books to learn Lotus and I’m currently learning and fixing small problems that occur with that. I’m also teaching myself some new skills here and there for my regular duties, as needed. We recently added technology which I am an expert on and does require a bit of extra work efforts. My teammates are not experts in this particular technology (which is a SQLServer database by the way). So, as you can see I do have quite a few skills, and greater skills, than my teammates.
