Question to Ask the Workplace Doctors about injury:
An employee had knee surgery. The doctor ordered him to stay home a couple of days. However, the employee decided he couldn’t afford to stay home so he came back to work. What liability does that put on the company as far as Workers’ Compensation or other liabilities?

Dear Who’s Liable?:
A lot of liability is placed on the company when an injured employee returns to work without his/her doctor’s permission. Normally, the HR Mgr requires a clean bill of health before an employee returns to work. The problem becomes complex if this employee receives a knee injury at work to the problematic knee. Who pays? He/she should not have been allowed to return.
